For safety reasons, we now require that everyone register their Microchip BEFORE we will ship your baby. 

Full AKC: AKC papers are given with no breeding restrictions on papers for puppies purchased with breeding rights.

Pet Only: This means that you do not plan to breed your baby, not that it is an inferior baby. We give substantial discounts on babies wanted strictly for family pets. Note: AKC restricted Papers are provided on proof of Spay/Neuter, Vet Verified by Microchip Number.

We WILL NOT sell puppies or semen to large breeders, breeders who keep their dogs outside, puppy mills, brokers, or pet shops, or to anyone associated with them. We reserve the right to refuse sale of any puppy from any person for any reason.   

Puppy Parents, when your shipper picks up your baby or the baby is accepted by an airline, this is the same as if you take possession personally. Once the baby leaves Rare Bulldogs, we are no way responsible for any occurrences in connection with the baby.

You as the new Puppy Parent, understand and agree that any shipper whether secured by you or Rare Bulldogs, does represent you in total responsibility for the puppy or dog once picked up by said shipping company or once accepted by any Airline Company.

As a courtesy, Rare Bulldogs will make arrangements to ship puppies. If this is not possible, as the Buyer, you agree to make arrangements to pick up or ship this pup by the available date shown in the RB Web Site Nursery or within 3 days of purchase if puppy is past 8 weeks.

As purchaser, you agree to be totally responsible for any vet bills, medications, shots, etc. incurred in connection with this pup or dog after the posted available date unless prior arrangements are made by the Buyer and agreed upon by the Seller in writing.

Purchaser understands that if this animal is left at Rare Bulldogs for 10 days after the available date without a written extension, constitutes abandonment. Rare Bulldogs has the right to sell this puppy for board, vet bills, medications, additional advertising and any other expense incurred in connection with the abandonment of this animal. No refunds will be made.

Our Flight Nannies work for the airlines and can only fly with their airlines and on STANDBY. This means that they cannot choose the day or arrival time for your baby's delivery, and they can be bumped from the scheduled flight at ANY time. They also can fly only to certain airports.

Because of this, you must have someone available that can go to the airport at any time on any day to pick up the baby. If you are late to meet the Nanny, he/she may have to return with the puppy at YOUR expense. Our Nannies CANNOT miss their return flight. There will be no refunds. If the Nanny has to stay overnight at any point, there is an EXTRA charge. By choosing this option for delivery, you are agreeing with this policy. 

Because of the nature of our business, we have a No Refund Policy under any circumstances. By making a deposit or payment to Rare Bulldogs, you are agreeing to this and all RB policies on our site rarebulldogs.com. When we hold a baby for you, it is taken off the market, and therefore hundreds of prospective customers are lost in connection with the OPTIMUM PURCHASE TIME of that particular puppy. This policy also applies to stud services and web design. Your deposit is always with us as an In-house Credit that can be used at any time, less any incurred expenses.

Note on the Lemon Laws: the ONLY reason Rare Bulldogs takes the position it does on the lemon laws is because we would not be able to enforce our NO REFUND, and NO VET BILL REIMBURSEMENT policies that are necessary for any successful breeder to stay in business. Otherwise, we have no problem with the laws of our States. 

Buyer acknowledges receipt of Florida Statute 828.29 known as The Florida Pet Lemon Law, from the seller via the RB website (printed below) and buyer agrees to waive all rights under such law. Buyer acknowledges the RB 5 year health and replacement guarantee posted on the RB website in place of the Lemon Law, which protects him in connection with the purchase of this puppy, as so disclosed in the guarantee. 

Florida Statute 828.29

It is the consumer’s right, pursuant to section 828.29, Florida Statutes, to receive a certificate of veterinary inspection with each dog or cat purchased from a pet dealer. Such certificate shall list all vaccines and deworming medications administered to the animal and shall state that the animal has been examined by a Florida-licensed veterinarian who certifies that, to the best of the veterinarian’s knowledge, the animal was found to have been healthy at the time of the veterinary examination. In the event that the consumer purchases the animal and finds it to have been unfit for purchase as provided in section 828.29(5), Florida Statutes, the consumer must notify the pet dealer within 2 business days of the veterinarian’s determination that the animal was unfit. The consumer has the right to retain, return, or exchange the animal and receive reimbursement for certain related veterinary services rendered to the animal, subject to the right of the dealer to have the animal examined by another veterinarian.

REQUIRED PAPERWORK

We require a copy of your females AKC Registration, her Pedigree, any DNA certificates you have, both color and AKC, and a photo, plus stud fee, before any stud services are reserved, rendered, or shipped. We WILL NOT RESERVE a spot with one of our studs without ALL required documents, contracts, and payment. If someone else calls and reserves a spot at the same time your girl is in, we will have no choice but to deny our services to you unless you have RESERVED our Stud properly. 

MUTUAL AGREEMENTS BY BOTH PARTIES

Both parties agree that the Rare Bulldogs name will not be used in the sell of the puppies of their dam. The STUD DOG name can be used as the name of the sire only. The puppies produced by this dam are the property of the bitch owner and are not puppies belonging to Rare Bulldogs and will not be sold as Rare Bulldogs puppies with the exception of "Pick Puppy Back Agreements". Pick Puppy Agreements will be noted in the "Other Considerations" portion of the Online Contract. Therefore in all advertising or selling of these pups Dam Owner will not use Rare Bulldogs as a selling key. 

Both parties agree that two live puppies constitutes a litter. Failure to raise the litter does not constitute a repeat breeding.

Both parties agree that their own dogs involved in this breeding are in good health and that all shots and worming are up to date before day of breeding to be verified by Veterinarian if necessary. Bitch owner agrees to be forthcoming with ALL vet info and records in connection with the birth should they be requested by RB. 

FAILURE TO CONCEIVE

Our service is to provide you with good quality, live, healthy, motile semen for your use. This is what you are paying for. There is much involved in this process which costs us money, time, and limits the use or our male for others. Conception after live, motile semen is delivered or inseminated is the sole responsibility of the Bitch owner and or your veterinarian. There must be accurate timing, proper procedures, and ovulation with eggs dropped in order for the semen to do its job. 

We provide a repeat breeding only if proper Progesterone Testing was done, and at no cost to purchaser except shipping expenses.

Bitch owner is to notify Stud Dog Owner 10 days before whelping, that the bitch is not bred and is to be due a repeat breeding. Failure to notify STUD DOG owner constitutes a null and void contract. A letter from a certified Veterinarian shall be provided to the STUD DOG owner for proof the bitch is not bred and for records in her file.

Both parties agree that if the stud dog dies or is not on the premises for breeding or is being used by another bitch at the time of repeat breeding, the Stud Dog owner will have the right to breed to another like male of their choice.

Both parties agree that any and all puppies produced as a result of this breeding cannot be sold or placed in puppy mills or purchased by brokers for the intent of resale of puppies. 

PROGENY QUALITY

Rare Bulldogs in no way guarantees the quality or health of puppies produced from this breeding. Both parties agree that the genetics, structure, quality, all health issues or problems, etc. are the sole responsibility of the Bitch Owner and that Rare Bulldogs is in no way responsible for any of the foregoing in any way or manner whatsoever. Rare Bulldogs certifies that at the time of this contract, to the best of their knowledge, there are no major health or genetic issues with the Stud Dog herein and that this breeding does not constitute inbreeding. 

STUD SERVICE CHARGES TO BE PAID

The owner of the Stud and the Bitch owner agree to the Payment of the posted stud fee for stud used for 2 inseminations or specimens. This amount must be paid by Rare Bulldogs accepted Payment Options as of the signing of the contract and 7 days BEFORE the first insemination or shipment unless this is an emergency arrangement. In shipment of Cooled Semen all Shipping charges are to be paid by Bitch Owner with the Stud Service Payment. 

PHOTO REQUIREMENTS

We require GOOD photos of any produced puppies for our studs Progeny Pages and to verify the litter. We reserve the right to use any and all photos in any way we choose. Registration Litter approvals will be done after acceptable photos are received by Rare Bulldogs. 

Herein: The online contract along with these policies herein, will be governed by the laws of the state of Florida and the county of Escambia and the city of Pensacola, Florida. All mediations, litigations or lawsuits will be conducted in the county of Escambia in the State of Florida. This constitutes the complete contract between both parties of said STUD DOG and BITCH in question. 

When we agree to POL, please realize that we are having to wait not 2 months for the pups to be born, but another 2 months before we can receive and sell the puppy in order to get our stud fee. On top of that, if the female does not take, then we are out all our hard work and get nothing. Remember, we reserve the male for you and your female for that week which means we turn away other stud services for which we get paid, so yes we lose out, a lot! 

Yet another issue comes to fruition with POL. It never fails that if a bitch owner has only 1 or 2 pups, the bitch owner never wants to give the stud owner their rightful stud fee, a pick puppy. I really do not get how a stud owner should be expected to give away semen. 

Two live puppies constitutes a litter, and it is up to the bitch owner to do the C-section at the right time, and have the proper experience and knowledge to keep the babies alive. It is also up to the bitch owner to breed at the right time. 99.9% of the time when a female does not take, it has absolutely nothing to do with the stud. It is always one of the foregoing factors: improper breeding time, female does not ovulate/drop eggs (the semen cannot fertilize an egg that is not there), or a sterile bitch. 

We sell and ship LIVE, VIABLE SEMEN, this is what you are paying for. 

All that being said, here is our POL policy:

*Rare Bulldogs gets first pick of the litter no matter how small unless there is only one puppy. The litter will be verified with photos and records from your vet directly to us within 24 hours of birth. 

*You are responsible to provide us with weekly, GOOD photos of ALL the puppies, and a complete physical vet checkup of the whole litter via our puppy check form by 3 to 4 weeks of age. Your vet must directly provide us with the results. 

*Also at 3-4 weeks, right after vet visit results, color DNA will be done at Rare bulldogs request on certain puppies. RB will require the least amount of testing to be done so as not to make this expensive to the bitch owner. 

*At that point, we will pick our puppy. If our pick puppy dies or gets sick, then the picking process will start over again even if you have promised puppies or fell in love with one of them. We are counting on you to keep our puppy healthy and alive.

*Until it is delivered to us in good health and condition, your stud fee is not paid.

*You are also responsible for delivering the puppy to Rare Bulldogs at your cost and with our Flight Nanny, NO ground or cargo shipping.

*You agree to register the litter after we choose our puppy, and will provide us Signed, Full Registration AKC papers upon receipt from AKC.

*The pick puppy's registered name will not be restricted in any way, and will be named solely by Rare Bulldogs.

If you think that any part of the above policy is out of line, too restrictive, or you do not agree, then PLEASE DO NOT ASK US FOR A POL STUD SERVICE.

5 Year HEALTH-DEATH-LOST-STOLEN  

We will replace your pet within the 1st 5 years of life under the following conditions:

1. HEALTH 

1a. In the event of the death/contraction of disease that greatly affects the life quality of your pet due to genetic or hereditary disease, Seller will replace the pet with another of equal value by the stipulations laid out below. Seller reserves the right to withhold certain puppies from the replacement program. Original pet if living, all documents requested by Seller, and signed AKC papers are to be returned to Seller no later than 7 days after exercise of this Guarantee. 

1b. In the event of the death/contraction of disease that greatly affects the life quality of your pet due to genetic or hereditary disease throughout the pet s first 5 years of life, Seller will issue a credit in the amount of the applicable percentage of the original cost towards the purchase of a replacement puppy of same or greater value. Credit is good for 90 days from date of death/contraction of the pet or if no puppy of the same breed & sex is available, time is extended until a puppy becomes available. Percentages as follows: Up to 1 year old: 100%, 13 months to 2 years old: 60%, 25 months to 3 years old: 40%, 37 months to 4 years old: 30%, 49 months to 5 years old: 20%

1c. Purchaser is responsible for the daily care and upkeep of the pet, including all immunizations and examinations recommended after purchase, as well as providing necessary vet visits, medication and follow-up treatments from vet visits. Documentation for this is to be provided to Seller upon request. 

2. DEATH

2a. Seller guarantees the life of your pet for 5 years as laid out below. The only exclusion is for the death of the pet due to negligence.

2b. In the event of the death of the pet due to accident, within the first 5 years of life, Seller will issue a credit in the amount of 40% of the original price for the first 3 years & 20% for years 4 & 5 toward the purchase price of a replacement pet of equal or greater value. Credit must be used within 90 days of the pets death or if no puppy of the same breed & sex is available, time is extended until a puppy becomes available. This does NOT include accident due to negligence of any kind. For example: letting your pet outside, and it runs in the road & gets hit by a car...this is negligence.

2c. In the event of the death of the pet due to accident, a death certificate from a licensed veterinarian must be presented to Seller within five days of the accident, showing cause and circumstance of death. 

3. LOST OR STOLEN

3a. In the event that the pet is lost or stolen, within the first 5 years of life, Seller will issue a credit in the amount of 50% of the original price towards the purchase price of a replacement pet of equal or greater value. Such credit must be used within 90 days of the pets disappearance or if no puppy of the same breed & sex is available, time is extended until a puppy becomes available.

3b. In the event that the pet is lost or stolen, the Buyer must advertise the lost pet in a major local newspaper for a period of one week starting twenty-four (24) hours after the loss. In addition, the Buyer must notify the police, Humane Society and Animal Control of the loss.

3c. The Buyer must present the Seller with copies of the police report, the advertisement and paid advertisement bill in order to exercise this Guarantee. 

APPLIED CONDITIONS: PLEASE READ CAREFULLY. FAILURE TO EXECUTE THE FOLLOWING WILL VOID YOUR 5 YEAR GUARANTEE.

Pet must be examined by a licensed vet within 24 hours of receipt, excluding Sundays, for a wellness check. Results MUST be e-mailed to us within 24 hours of wellness check. Please make an appointment for a wellness check before you receive your baby. All vet visits, nutrition receipts, etc. must be kept & made available to Seller upon request & upon exercise of this guarantee. 

Buyer must notify Seller office by phone immediately (within 24 hours) of the diagnosis of the condition and request a replacement puppy.

All shots, worming, and heartworm preventative must be kept up to date and documented by a licensed Veterinarian, records of which are to be provided to Seller by e-mail upon request.

A heartworm test must be done on living pets by your Vet and the results must be Negative. If a positive test results, your pet does not qualify for replacement, and this guarantee is VOID. 

The pet must not be altered in any way. 

Note: Spaying or neutering young animals (before 2 years of age) can contribute to improper bone, muscle growth, & maturity, which is especially important in the Bulldog Breeds. 

The pet, if alive, signed AKC Papers, All Health Records, and any other requested documents must be returned to Seller at Owners expense within 7 days of a replacement request to be eligible for a replacement.

Pet must be kept on NuVet Supplements for life and be fed what is considered a high grade dog food. Most foods purchased from PetSmart are eligible. Most foods purchased from Walmart will void this guarantee, except Purina One Foods. Also, Purina Puppy Complete is acceptable. Keep ALL receipts! We will ask for them. NuVet Supplements purchased from the link on our site will generate a receipt to us for your convenience. 

Pets microchip must be registered in the Purchasers name within 30 days of receipt of pet.

Buyer must supply to seller immediately ANY requested receipts, vet records, or any other request from seller at any time.

The value of the pet for the purpose of this guarantee is solely the original purchase price, not including shipping costs, crate, health certificate, or other costs. 

Replacement pets have NO Guarantee; Seller cannot & does not replace replacement pets. 

Any condition found to be the fault of improper care or diet is NOT Covered under this Guarantee.

Any condition or illness contracted AFTER the Buyer takes possession of the pet is NOT covered by this Guarantee. Example: Pneumonia. Hereditary conditions are present at birth & therefore cannot be contracted.

Seller will replace pet with the 1st available equal of the same breed, & sex. I understand that Seller has the right to withhold specific puppies from the replacement program at their choosing. 

Seller will not pay Vet Bills or reimburse me for any Vet or Other Bills in connection with original pet or replacement pet under ANY circumstances.

Venue and jurisdiction for litigation arising out of or related to Seller shall lie exclusively in Escambia County, Florida. 

Seller will not accept any returns other than pursuant to the Guarantee, below and under those circumstances only, shall the Pet shall be replaced.

Limitations of Guarantee: The Guarantees herein are non-transferable. The pet must be in good physical condition. No replacement will be given if the pet has been bred or develops hip dysplasia due to excessive weight gain resulting from the dog being neutered or spayed. No replacement will be given if breeds that are known to be prone to hip dysplasia are overweight or over-exercised. No replacement will be given if the registration application form has expired.

Customer must follow the seller recommended nutritional program, including recommended food and vitamin supplements. Customer must retain all receipts for food, vitamins and vet records to show adherence to this guarantee.

Pets must not be over-exercised during their growth period, the first two years of life.

All of the above-mentioned conditions must be met or all Guarantees will be void. A licensed veterinarian must do all laboratory verifications. Customer is responsible for transportation costs to and from Seller. If pet is found and certified by a licensed veterinarian to have congenital or hereditary disorders that adversely affect the health of the animal, and if Seller is notified within two business days of the veterinarian's determination, then Seller will provide a replacement pet of equal value under the terms herein. However when making a claim, Seller may request the customer to get a second opinion from another vet before being reviewed by our vet. Seller will not be responsible for veterinarian fees or shipping costs. Seller is not responsible for any veterinarian expenses accumulated on returned or replaced pet.

Other Considerations: Transportation is arranged through third party carriers frequently there are delays for numerous reasons including but not limited to weather, logistics, mechanical failure or other unforeseen events. Seller shall not be responsible or liable directly or indirectly for any delays that may cause you inconvenience or financial loss. 

This contract/guarantee is not valid outside the United States or Canada, nor is the contract, or the guarantee herein assignable.

Registration papers for all registered puppies will be sent in the Puppy Kit or if not obtained from AKC yet, by regular mail. If the papers are lost, the purchaser is responsible for the cost of obtaining new papers. However, we will assist you by providing a copy of these papers.

If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Rare Bulldogs Content accessed through https://www.rarebulldogs.com/ in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend and hold harmless Rare Bulldogs, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Rare Bulldogs reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Rare Bulldogs in asserting any available defenses.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrators award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Employer agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RARE BULLDOGS AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF RARE BULLDOGS OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. Termination/access restriction 

Rare Bulldogs reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Florida and you hereby consent to the exclusive jurisdiction and venue of courts in Florida in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Rare Bulldogs as a result of this agreement or use of the Site. Rare Bulldogs's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Rare Bulldogs's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Rare Bulldogs with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Rare Bulldogs with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Rare Bulldogs with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
